On the conceptual apparatus of state control (supervision) in the field of health protection

Abstract


The article is devoted to the improvement of the conceptual apparatus of state control (supervision) in the field of health protection in terms of preventive measures. The article examines the structural features of the term «prevention» provided for in various areas of legislation, and also studies the specifics of preventive measures provided for by the provisions on state control (supervision) in the field of circulation of medicines, as well as the quality and safety of medical activities. Definitions for various types of preventive measures have been developed and proposed, aspects have been identified in relation to which legislative improvement is potentially possible. The application of the above proposals will ensure a uniform interpretation and application of various preventive measures, as well as take into account the specifics of the healthcare sector, including centuries-old experience in risk management.
